General Terms and Conditions

  • In case of a refusal of acceptance, breakage or damaged goods, a notification by phone to our disposition should be occur immediately. In case of non-compliance, a processing fee of € 100.00 will be charged.
  • Unless expressly agreed otherwise, loading and unloading shall be carried out by the carrier.
  • Cessions of freight reimbursement are prohibited and not recognized by us. Should problems occur in order processing, we must be informed immediately. The driver is responsible for weight and stick count control. Loading equipment must be exchanged step by step and documented with a loading voucher. The return of non-exchanged loading equipment within 14 days is deemed to be agreed. Not timely returned loading equipment will be charged, Euro pallets with 12,00 € per Euro pallet. CC containers with 65,00 € each, board to CC containers with 10,00 € each, skids with 1,50 € each.
  • 8 hours for loading and unloading incl. idle time are in each case free. The driver is responsible for operational and roadworthy load securing. The loading area must be clean, dry and odorless. For partial lots taken over persists a ban on loading together with non-food-compliant goods types. In addition, the cargo must be secured again access by third parties.
  • The driving personnel employed must comply the hygiene regulations and directives (e.g. Speed limit, etc.) at the shipper and recipient.
    For the transport execution, the statutory provisions apply in accordance with the vehicle used in connection with the “Allgemeinen Deutschen Spediteurbedingungen (ADSp)” applicable to our activity, in the currently valid version. In case of damaged goods 40 SZR (§ 431 HGB) per kg volume weight are deemed to be agreed. In case of international transport, the provisions of the CMR are deemed to be agreed. We assume that you are using a CMR-insured vehicle.
  • The carrier assures to dispose permissions and authorizations required for the transport and according to §3 and 6 GOKG (permission, Eurolicense, third country permission, CEMT-permission). The carrier undertakes to only provide drivers with the required work permission. It also undertakes to ensure that the driving personnel disposes of an official certificate with an officially authenticated translation in german according to §7 Abs. 1 S.2 GüKG and carries it on every trip. In case of inspection, the carrier undertakes to hand over to the freight forwarder, on request, all documents that have to be carried at inspections by the freight forwarder.
    In case of use of foreign transport companies, the contractor undertakes to have checked the following criteria, which are subject to the cabotage regulations
    (a) an international transport operation has taken place immediately before;
    (b) when entering with a loaded vehicle, no more than two transports were carried out, with the last unloading taking place within seven days after the last unloading of the imported goods.
    c ) when entering with an unloaded vehicle, the transport is carried out within 3 days.
    Should a claim be made against the client by a third party, cause the contractor violated the provisions of the cabotage regulations, the contractor shall release the client on first request from all claims of third parties, based on a violation of the obligations arising from the cabotage regulations.
  • The contractor undertakes, in addition, to compensate the client for these imposed fines in their entirety, which are based on violations against the cabotage regulations by the contractor or a third party commissioned by him.
  • The cargo/shipment may only be passed on to third parties with our consent. Should we receive delivery receipts that we had to request in order to determine that claims processing was necessary, we reserve the right to charge an handling fee of 75,00 €.
  • The original delivery documents must be submitted to the customer within 8 days of transport execution. The delivery document includes original consignment note, delivery notes, temperature printout and pallets data sheets and pallets exchange receipts.
